Terms of Service

You need an account to generate designs or place an order. We don't use passwords at all — you sign in with Google or Apple, or with a one-time link we email you. You're responsible for keeping access to whichever email address or provider account you sign in with, because anyone who controls that controls your Boardside account.

• You must be at least 16 years old to hold an account, and at least 18 to place an order.
• Give us an email address you actually control. We verify it before your account is fully active.
• One account per person. Creating additional accounts to collect extra free credits is a breach of these Terms.
• Don't share your account or let someone else order through it.

We may suspend or close an account that breaches these Terms, that we reasonably believe is being used fraudulently, or that is the subject of a payment dispute. Where we can, we'll tell you why and give you a route to respond.

Generating a design costs us real money every time, so generation runs on credits. New accounts start with a set number of free credits, and every completed order adds more. Your current balance is shown on your account page.

• Credits are a usage allowance, not currency. They have no cash value, can't be bought, sold, transferred, or exchanged for money, and we may change how many credits an action costs.
• If we refuse your prompt under our design rules before generation starts, no credit is used.
• If a generation fails for a technical reason on our side, email support@boardsideapparel.com and we'll restore the credit.
• A generation that completes uses its credit even if you don't like the result. That's the cost of the attempt, not of your satisfaction with it.
• Don't try to work around rate limits, credit limits, or the moderation pipeline — via scripting, multiple accounts, or anything else.

Previews are watermarked and low-resolution on purpose. The clean, print-resolution file is produced and sent to our print partner only after your order is paid for and approved.

You are responsible for what you ask us to print — whether you prompted for it, customized a template, or uploaded it. By submitting a prompt or an image, you confirm that you have the right to use it and that printing it won't infringe anyone else's rights.

We won't print:

• Trademarks, logos, team or league marks, or brand names you don't own or have written permission to use. This includes professional and collegiate sports marks.
• Copyrighted artwork, characters, or photographs belonging to someone else.
• Real people's names, likenesses, or signatures without their permission — including celebrities and public figures.
• Hateful, harassing, or violent content, or content that targets a person or group.
• Sexual content, or any depiction of a minor in a sexual or exploitative context.
• Content promoting self-harm, illegal activity, or the manufacture of weapons or drugs.
• Anything we're legally required not to produce.

We screen prompts before generating, screen the resulting image, and review every purchased design before it goes to print. If something is turned down we tell you which rule it hit. Our judgment on what we'll print is final — we can decline any design for any lawful reason, including print quality.

You keep ownership of the prompts you write and the artwork you upload. We don't claim ownership of them.

To actually run the service, you give us a non-exclusive, worldwide, royalty-free license to store, process, modify, and reproduce your prompts and images for the limited purposes of: generating and previewing designs, running moderation and quality checks, printing and shipping your order through our print partner, handling support and payment disputes, and keeping the audit records described in our Privacy Policy.

That license does not let us market your design, sell it to anyone else, or publish it in our template gallery. We will never do any of those without asking you separately and getting your explicit opt-in.

You can ask us to delete your uploads and generated designs at any time — see the Privacy Policy for how, and for the narrow records we're required to keep.

As between you and us, the design you generate is yours to use, including commercially — on your own team's gear, in your own materials. We don't take a cut and we don't restrict what you do with it.

One honest caveat: under current United States law, material generated by AI without meaningful human authorship may not be eligible for copyright protection. That means we can't promise you an exclusive right to a generated design, and we can't promise that a similar design won't be generated for someone else. If exclusivity matters to your team or league, talk to a lawyer before relying on it.

We retain ownership of the site itself, our template designs, our brand, and the software behind all of it.

Every product is made to order. Prices are shown in US dollars and exclude tax and shipping unless stated otherwise; applicable tax is calculated at checkout.

• Payment is handled by Stripe. We never see or store your card details.
• Your order is an offer to buy. It's accepted when the design passes review and we submit it for production — not at the moment of payment.
• If a design doesn't pass review, we cancel the order and refund you in full, automatically. See Shipping & Returns.
• We may correct obvious pricing errors and cancel affected orders with a full refund, even after payment.
• You're responsible for the shipping address you enter. We can't reroute an order once it's in production.

Because every item is custom-printed for you, returns work differently than they would for stock merchandise. The full policy — production and delivery times, the 30-day window for defects, misprints, and transit damage, and what isn't covered — is set out in Shipping & Returns, which forms part of these Terms.

Don't:

• Scrape, crawl, or bulk-download the site, or resell access to it.
• Probe, scan, or test the security of the site, or try to bypass rate limits, authentication, or moderation.
• Use automated tools to generate designs at volume.
• Reverse engineer the service, or use it to train a competing model.
• Upload malware, or anything designed to interfere with the site or other users.

We log requests and keep audit records of generation activity. Abuse gets your account suspended, and we'll cooperate with law enforcement where we're required to.

We work hard on print quality, but the site and the designs it produces are provided “as is”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Specifically, we don't warrant that generated designs will meet your expectations, that the site will be uninterrupted or error-free, or that printed colors will match your screen exactly — screens are backlit and fabric is not, and some variation between the preview and the finished product is normal.

Nothing here excludes liability that can't legally be excluded, including for fraud, or for death or personal injury caused by negligence. Some states don't allow certain warranty exclusions, so parts of this section may not apply to you.

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data, arising out of these Terms or your use of the site.

Our total liability to you for any claim relating to the site or an order is limited to the greater of the amount you paid us in the twelve months before the claim, or US $100.

If someone brings a claim against us because of a design you asked us to print — a trademark or copyright claim, a right-of-publicity claim, or anything similar — you agree to cover our reasonable costs, damages, and legal fees in defending it. This is the practical consequence of the rights confirmation you give in section 3, and it's why we review every design before printing.

You can stop using the site at any time and ask us to close your account. We can suspend or terminate your access if you breach these Terms, if we're required to by law, or if we discontinue the service. If we close your account, any unused credits are forfeited — they have no cash value. Orders already in production will still be fulfilled unless the design itself is the problem. Sections 4, 5, 9, 10, 11, and 14 survive termination.

We may update these Terms as the service changes. The “last updated” date at the top always reflects the current version. If a change materially reduces your rights, we'll give you notice by email or on the site before it takes effect. Continuing to use the site after that means you accept the new version. Changes never apply retroactively to an order already placed.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located there, and both parties consent to that jurisdiction. Nothing stops either of us from bringing a qualifying claim in small claims court.

Before filing anything, please email support@boardsideapparel.com. Nearly everything — misprints, refunds, a design that got turned down — is resolved faster that way than through a court.
